1. Acceptance of Terms

By accessing or using Rally On (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

Rally On is a platform that connects tennis players for matches. These Terms govern your use of our Service.


2. Description of Service

Rally On allows users to:

  • Create profiles with tennis skill ratings and location information
  • Search for other players based on skill level, location, and court preferences
  • Communicate with other users through in-app messaging
  • Arrange tennis matches and connect with the tennis community

Service Availability: Rally On currently operates in Toronto, Vancouver, Montreal, New York City, and Los Angeles. We may expand to additional cities in the future. While you may access the Service from other locations, matching functionality works best in our supported cities.


3. Age Requirements and Recommendations

We strongly recommend that users be adults (18 years or older). While Rally On does not verify ages, by using the Service you represent that:

  • You are at least 13 years of age
  • If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you have your parent or guardian's permission to use the Service
  • You understand that Rally On does not verify user ages and you may encounter users of various ages

Rally On is not intended for children under 13 and we do not knowingly collect information from children under 13.


4. Account Registration and Security

To use Rally On, you must create an account. You agree to:

  • Provide accurate and truthful information
  • Maintain the security and confidentiality of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Be responsible for all activities that occur under your account

Rally On is not responsible for any loss or damage arising from your failure to maintain account security.


5. User Responsibilities and Prohibited Conduct

What You Must Do:

  • Provide accurate information in your profile
  • Be respectful and courteous in all interactions
  • Use the Service only for connecting with tennis players
  • Comply with all applicable laws and regulations
  • Treat other users the way you'd want to be treated

What You Must NOT Do:

Identity and Profile Violations:

  • Create fake profiles or impersonate others
  • Use someone else's photos without permission
  • Create multiple accounts without authorization
  • Misrepresent your skill level, location, or other profile information

Harmful Conduct:

  • Harass, abuse, threaten, or harm other users
  • Share hate speech or discriminatory content
  • Engage in any illegal activities
  • Share false or misleading information
  • Use Rally On if you are a registered sex offender

Commercial Violations:

  • Use Rally On for commercial solicitation or advertising (unless explicitly partnered with Rally On)
  • Share contact information for services unrelated to tennis
  • Request money or financial information from other users

Technical Violations:

  • Use automated tools, bots, or scrapers to access the Service
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of the Service

6. Profile Photos

Your profile photo must:

  • Show your face clearly
  • Be a recent photo of you (not someone else, not a celebrity)
  • Be appropriate (no nudity, violence, hate symbols, or offensive content)
  • Not include minors unless you are the minor in the photo
  • Not violate anyone else's copyright or privacy rights

Rally On reserves the right to remove photos that violate these guidelines without notice.


7. User-Generated Content

Your Messages and Content

You retain ownership of the messages and content you create on Rally On. However, by using the Service, you grant us the right to store, transmit, and display your content as necessary to operate the Service.

Content Standards

All user-generated content must:

  • Be respectful and appropriate
  • Not contain hate speech, harassment, or discriminatory language
  • Not violate any laws or regulations
  • Not infringe on the rights of others
  • Not contain spam or promotional content unrelated to tennis
  • Not include sensitive personal information (financial data, government IDs, health information)

Analysis and Processing

By using our messaging system, you acknowledge and agree that:

  • Rally On may analyze your communications using automated tools, including artificial intelligence, for service improvement, safety monitoring, and quality assurance
  • This analysis uses de-identified data where personally identifiable information has been removed or anonymized
  • We implement safeguards to protect your privacy during analysis
  • Analyzed data helps us improve matching quality, detect safety issues, and enhance user experience

Message Retention

  • Active accounts: Messages are retained indefinitely while both users' accounts remain active
  • Deleted accounts: When you delete your account, your messages are permanently deleted within 30 days
  • No individual deletion: Users cannot delete individual messages after sending
  • No export: Users cannot export their chat history
  • Other user's view: When you delete your account, other users will lose access to your chat history

8. NTRP Skill Ratings

  • NTRP ratings on Rally On are self-reported by users
  • Rally On does NOT verify or validate skill ratings
  • Misrepresenting your skill level may result in poor match quality and user complaints
  • Repeatedly misrepresenting your skill level may result in account warnings or suspension

9. Court Information

Court Listings:

  • Court information is user-generated, user-requested, or sourced from public databases
  • Rally On does NOT guarantee the accuracy, availability, or condition of listed courts
  • You are responsible for verifying court availability, fees, booking requirements, and rules before arriving
  • Users can request courts to be added; Rally On reviews and adds courts at its discretion
  • If you notice incorrect court information, please report it to rallyon.app@gmail.com

10. Content Moderation and Account Termination

Reporting System

Users can report concerning behavior through our in-app reporting system. We review all reports confidentially.

Account Actions

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

  • Violation of these Terms
  • Inappropriate behavior or content
  • Fraudulent or illegal activities
  • Safety concerns or threats to other users
  • Any other reason we deem necessary to protect our Service or community

Appeals Process

  • Review timeline: We aim to review reports within 7 business days
  • Warnings: We may issue warnings before suspension for minor violations
  • Appeals: If your account is suspended, you may appeal by contacting rallyon.app@gmail.com within 7 days with your account information and explanation
  • Final decisions: Account terminations for serious violations (harassment, hate speech, safety threats) are final and not subject to appeal

Account Deletion by User

You may delete your account at any time through your account settings. When you delete your account:

  • Your profile and data will be permanently deleted within 30 days
  • Your chat messages will be removed from other users' views
  • There is no grace period - account deletion cannot be reversed
  • Other users will lose access to your conversation history

11. CRITICAL SAFETY INFORMATION

Rally On Does NOT:

  • Conduct background checks on users
  • Verify user identities, photos, ages, or skill ratings
  • Vet users for criminal history or past behavior
  • Verify that profile photos are actually of the account holder
  • Monitor all user communications in real-time
  • Guarantee the safety of any in-person meetings

Your Responsibility

When meeting other users in person, YOU are responsible for your own safety. We strongly recommend:

  • Meet in public places
  • Inform someone of your plans
  • Trust your instincts and prioritize your safety
  • Follow all applicable health and safety guidelines
  • Ensure you have appropriate insurance coverage for tennis activities
  • Never send money to people you meet on Rally On
  • Be suspicious of requests for financial help or "emergencies"
  • Don't share financial information or passwords
  • Report suspicious behavior immediately

Scam Protection

  • Rally On will NEVER ask for your password or payment information via email or chat
  • Never send money to other users
  • Report any suspicious requests immediately

12. Fees and Payment

Rally On is currently free to use. If we introduce paid features or subscriptions in the future:

  • We will provide advance notice of any fees
  • Pricing will be clearly displayed before purchase
  • All fees will be in the applicable local currency
  • Payment processing will be handled by third-party payment processors
  • We will clearly communicate refund policies at that time
  • You will be able to cancel paid services through your account settings

13. DISCLAIMER OF WARRANTY

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

Rally On is a platform to connect tennis players. We are NOT responsible for:

  • The accuracy of information provided by other users
  • Any interactions, communications, or meetings that occur between users
  • Any injuries, damages, disputes, or harm that may arise from in-person tennis matches or meetings
  • The behavior or actions of other users on or off the platform
  • Lost matches, scheduling conflicts, or failed coordination
  • Court conditions, availability, or safety
  • Any financial losses or damages resulting from use of the Service

14. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

RALLY ON, ITS CREATORS, OPERATORS, MEMBERS, AFFILIATES, PARTNERS, AND ANY INDIVIDUALS ASSOCIATED WITH RALLY ON SHALL NOT BE HELD MONETARILY LIABLE OR RESPONSIBLE IN ANY WAY FOR:

  • Any injuries, harm, damages, or losses arising from your use of the Service
  • Any interactions, meetings, or relationships formed through the Service
  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Any wrongdoing, misconduct, or illegal activities by other users
  • Any disputes between users
  • Any failure to find matches or coordinate games
  • Any misrepresentation by other users
  • Any security breaches or unauthorized access to your account
  • Any errors, bugs, or technical issues with the Service

IN NO EVENT SHALL THE TOTAL LIABILITY OF RALLY ON OR ANY ASSOCIATED INDIVIDUALS EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY (CURRENTLY $0).

BY USING RALLY ON, YOU ACKNOWLEDGE AND AGREE THAT YOU USE THE SERVICE ENTIRELY AT YOUR OWN RISK.


15. Indemnification

You agree to indemnify, defend, and hold harmless Rally On, its operators, members, and any associated individuals from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another user
  • Your meetings or interactions with other users
  • Any content you post or share on the Service
  • Your negligence or misconduct

16. Service Interruptions and Force Majeure

Rally On is not liable for service interruptions, delays, or failures due to circumstances beyond our reasonable control, including:

  • Natural disasters, pandemics, or acts of God
  • Government actions, regulations, or court orders
  • Internet service provider failures
  • Cyberattacks or security incidents
  • Third-party service outages
  • Power outages or infrastructure failures

17. Intellectual Property

The Rally On platform, including its design, functionality, branding, and content (excluding user-generated content), is owned by Rally On and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without permission.

The Rally On name, logo, and raccoon mascot are proprietary to Rally On.


18. Third-Party Services

Our Service integrates with and relies upon third-party services for various functions including authentication, data storage, email delivery, hosting, analytics, and other operational needs. Your use of these integrated services may be subject to their respective terms and privacy policies. We are not responsible for third-party services or their performance.


19. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using Rally On, you also agree to our Privacy Policy.


20. Modifications to Terms

We may modify these Terms at any time. We will provide notice of material changes by:

  • Posting the updated Terms on our platform
  • Updating the effective date
  • Sending an email to your registered email address (for significant changes)

Your continued use of the Service after such changes constitutes acceptance of the new Terms. If you do not agree to the changes, you must stop using the Service and delete your account.


21. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Ontario, Canada. By using Rally On, you consent to the jurisdiction of these courts.


22. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect.


23. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Rally On regarding use of the Service and supersede any prior agreements.


24. No Waiver

Our failure to enforce any provision of these Terms shall not be deemed a waiver of such provision or our right to enforce it.

The following information is visible to other logged-in Rally On users to facilitate player matching:

Your last name, email address, and private messages are NOT publicly visible.

Deleted Accounts:

  • When you delete your account, your profile information and messages are permanently deleted within 30 days
  • De-identified, aggregated data used for analytics may be retained but cannot be linked back to you
  • Some data may be retained longer if required by law

No Grace Period

Once you delete your account, there is no grace period to recover it. Account deletion is permanent and cannot be reversed.

Message Deletion

  • Users cannot delete individual messages after sending
  • When you delete your account, all your messages are removed from other users' views within 30 days
  • Users cannot export their chat history

7. Your Rights and Choices

You have the right to:

Access and Update:

  • Access the personal information we have about you
  • Update or correct your account and profile information through your account settings

Delete:

  • Delete your account and associated data at any time through your account settings
  • Once deleted, your data is permanently removed within 30 days

Opt Out:

  • Request a copy of your profile data (subject to technical limitations)
  • Note: You cannot currently export chat history
